AI Terms of Use

1. What these terms cover

These terms apply when you create your own card design in our shop, from a photo or with AI. They are offered by Gifting Technologies GmbH, The Delta Campus, Donaustraße 44, 12043 Berlin, Germany and add to our Terms and Conditions and Privacy Policy; buying and redeeming a card stays under the Terms and Conditions. You accept them with “Agree and continue” with every new design.

2. How it works

• Photo design: you upload a photo and we put it on the card. Free.

• AI design: you describe a picture, optionally with up to 5 photos, and AI draws the card front and suggests a message for the back. You can ask for changes.

• Image count: AI designs and changes use one image each. You have 10 images; a used one comes back every hour. A request that fails or times out uses none.

• Everything is free of charge. Images have no cash value and cannot be bought or transferred.

• We may change, limit or stop these features at any time.

3. Your photos and words

Only use photos you own or have permission to use, including the consent of everyone recognisable in them (for children, their parent). You let us store, edit and print your photos and words, and send them to our AI providers, only to make your design and your card. We do not use them to train AI or for advertising.

4. What’s not allowed

Cards are for birthdays, thanks, love, pets, hobbies and gentle humour. Not allowed:

• sexual content or nudity, and anything involving minors in that way

• hate, extremism, violence, threats, crime, drugs or self-harm

• insulting or humiliating a person

• brand logos, ID documents, bank cards, celebrities

• tricking the AI or using the features automatically

Every request is checked automatically before a design is made. If it breaks these rules, no design is made and we tell you why. Your first refusal is free; later ones use an image. The check can be wrong; you can rephrase or write to hello@givingjoy.de.

5. Your designs

You may use your designs privately, on the cards you buy from us. AI results vary, are not reviewed by a person, and may resemble existing works or look like others’ results; check them before you buy. AI pictures may not be protected by copyright, so no one may have exclusive rights in them.

6. Your data

• Your designs live in a browser session that ends 7 days after your last visit.

• We use Anthropic to check content and suggest card messages, and OpenAI to generate images. To provide these features, we send your text and, where needed, uploaded photos to these providers for processing on our behalf. Processing may take place outside the European Economic Area, including in the United States. • Photos and designs are deleted 1 day after the session ends, unless printed on a card you bought.

• Your IP address is deleted after 30 days. Records of designs and refusals, including your descriptions, are anonymised after 30 days.

7. Liability and changes

We are liable as set out in our Terms and Conditions. If someone claims against us because of photos or words you used without permission, you cover that claim. We may update these terms; you will be asked to accept the new version before your next design. German law applies; your mandatory consumer rights stay unaffected.
